There is disagreement about how quickly eligibility needs to be dealt with for the land claim to proceed. The group agrees that only the residency requirement concept should be recommended to the communities. They discuss how to get documented proof from the communities on how they feel. The workshop winds down for the day and plans are made to reconvene in the morning to agree on recommendations for the Friday Board meeting. Plans for the Board meeting travel are also discussed.

Facilitator Barry Roberts summarizes some of the eligibility criteria being proposed: descendant of one of the five tribes of the Northwest Territories, Canadian citizen, born in the present boundaries of the NWT (including children born to a mother normally resident in NWT) or ordinarily resident in the NWT on a set date, the adopted minor child of any of the above, recognized by one of the communities as having established rights through prior land use and occupancy, and the descendants of anyone who meets these criteria. Benefits would be for those so enrolled and ordinarily resident in the Northwest Territories. Charlie Overvold indicates that they need to agree on a basic criteria concept and get it accepted by the communities. He wants them to formulate a plan to find out what people want. Roberts suggests that the Board come to a decision and send it as a recommendation to the communities, which they can discuss and notify the Board whether they agree or not. Charlie Overvold favours the residency requirement concept over the cut-off date concept because it will allow all Indigenous people to be treated equally in the future, whether they move in from outside or not. This item is the first part of four-part recording of a joint Metis Association and Dene Nation leadership meeting at the Lions Den in Yellowknife, recorded September 26, 1980. The recording is in English and several Indigenous languages. The original source item is side A of a 90 minute audio cassette. The meeting also includes item CN-404B, CN-120A, and CN-120B. The purpose of the meeting is to discuss strategy for the upcoming Norman Wells pipeline National Energy Board (NEB) hearings and prepare for two workshop days in which arguments would be developed, speakers chosen, and statements drawn up with the assistance of resource people. A schedule is outlined and discussed. An unidentified speaker provides an update on the Norman Wells pipeline, outlining the work of the Environmental Assessment and Review Panel (EARP), which had visited communities along the pipeline right of way to listen to people’s views on the pipeline. Many chiefs and people communicated that they did not want the pipeline built until their rights were settled. The next stage of the process is the NEB hearings, scheduled to begin October 7. A speaker indicates that the Dene Nation has made it clear that they are not interested in talking about pipelines again and have tried to delay an approval decision, travelling to Ottawa to meet with the Minister of Indian Affairs and Northern Development on two occasions and hosting the Minister at the Dene National Assembly. Since the NEB requires statements to be written and submitted in advance, they have a tight time schedule to keep. Lawyer John Olthuis describes the NEB hearing schedule and process, emphasizing the importance of having a large contingent of chiefs in Edmonton for the opening of the hearings and the presentation of the opening statement. He indicates that southern supporters will be presenting during the Edmonton phase of the hearing, with the majority of the Dene Nation statements being delivered in Yellowknife or perhaps in some of the Dene communities, if the NEB is asked to visit them.

The difficulty of Cree people who have moved in to the NWT recently is mentioned again. Jim Koe tells a story about travelling to communities, land claims, and Indigenous organizations working together. Charlie Overvold suggests that there are two concepts that could be put before the communities: having a cut-off date or a residency requirement. Roberts describes the different ways of methods of determining eligibility that had been used in the James Bay, Yukon, and Alaskan claims. He suggests that the Territorial Board take on the task of deciding what eligibility should be before taking it back to the communities for agreement. He indicates that strict rules can be applied by staff members and difficult cases could be referred back to the Board. Completed lists could be sent to local committees for examination and community approval. After a coffee break, Roberts describes eligibility criteria like a law of selection, which should be short and precise, without ambiguity or personalities, and against which future court protests can be considered.
